📋 Please Read Carefully: By using the services of Baste Tour and Travel, you agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you and Baste Tour and Travel.
1. Definitions & Company Information
- "Company" / "We" / "Us": Baste Tour and Travel, a sole proprietorship owned and operated by Somnath Baste, registered at Hadapsar, Pune, Maharashtra, India
- "Client" / "You": Any individual, corporate entity, or organization using our services
- "Services": All cab, transportation, and travel services offered by Baste Tour and Travel
- "Driver": Any person employed or contracted by us to operate vehicles
- "Vehicle": Any cab, car, SUV, or transport vehicle operated under Baste Tour and Travel
- "Baste Go App": The mobile application (under development) for ride booking and tracking
- "Corporate Contract": A formal agreement between the Company and a corporate entity for regular transportation services
2. Legal Compliance & Regulatory Framework
Baste Tour and Travel operates in full compliance with the following Indian laws and regulations:
- The Motor Vehicles Act, 1988 (as amended) and Central Motor Vehicles Rules, 1989
- Maharashtra Motor Vehicles Rules and Maharashtra RTO regulations
- Maharashtra Aggregator Cabs Policy, 2025
- Motor Vehicle Aggregator Guidelines, 2025 (Ministry of Road Transport & Highways)
- The Indian Contract Act, 1872
- The Consumer Protection Act, 2019
- The Goods and Services Tax (GST) Act, 2017
- The Payment of Wages Act, 1936 and applicable labor laws
3. Vehicle Compliance — Maharashtra RTO & Yellow Plate Rules
🛑 All vehicles operated by Baste Tour and Travel are fully RTO-compliant:
3.1 Yellow Number Plate (Commercial Registration)
- All vehicles carry yellow number plates with black lettering as mandated for commercial/contract carriage vehicles under Section 66 of the Motor Vehicles Act, 1988
- Vehicles are registered as commercial transport vehicles under Maharashtra RTO with valid permits
- Registration codes follow the Maharashtra format (MH-XX-XX-XXXX) with appropriate commercial series
3.2 HSRP (High Security Registration Plates)
- All vehicles are fitted with HSRP plates as mandated by the Maharashtra Transport Department and MoRTH
- HSRP plates include chromium-based hologram, laser-branded identification number, "IND" inscription, and non-removable snap-lock mechanism
- Compliance verified as per the SOP issued by Maharashtra Transport Department (December 2024)
3.3 Permits & Certificates
- Contract Carriage Permit: Valid permit under Section 74 of Motor Vehicles Act for all vehicles
- Fitness Certificate: Valid and renewed as per Maharashtra RTO schedule
- Pollution Under Control (PUC) Certificate: Valid for all vehicles
- Comprehensive Insurance: Third-party and comprehensive motor insurance for every vehicle
- Passenger Insurance: Coverage for all passengers during the ride
- Road Tax: Paid in full as per Maharashtra Motor Vehicle Taxation Act
- Vehicle Age: No vehicle older than 10 years is used in our fleet
3.4 Vehicle Standards
- All vehicles meet BS-VI emission norms
- Air-conditioning, first-aid kit, fire extinguisher, and dashcam in every vehicle
- Daily hygiene check, weekly deep cleaning, monthly mechanical inspection
- Speedometers and GPS devices calibrated and functional at all times
4. Driver Compliance
- All drivers hold a valid commercial driving licence (yellow badge / transport licence) issued by an Indian RTO
- Minimum 3 years of professional driving experience required
- Police verification clearance from Maharashtra Police / local police station
- Medical fitness certificate issued by a registered medical practitioner
- Drug & alcohol test clearance
- Mandatory completion of Baste safety & sensitivity training program
- Aadhaar-verified identity linked to our system
5. Service Terms
5.1 Booking & Scheduling
- Services can be booked via WhatsApp (+91 7507958364), phone call, email (bastetravels@gmail.com), or through the Baste Go app (when available)
- Corporate contracts are formalized through a written agreement specifying routes, schedules, vehicle type, pricing, and terms
- Individual bookings are confirmed upon acknowledgment via WhatsApp or phone
5.2 Ride Policies
- Passengers must be present at the designated pickup point at the scheduled time
- A waiting time of 10 minutes is provided free of charge; beyond that, waiting charges apply as per the contract
- Route changes during a ride must be communicated to the driver and may incur additional charges
- Maximum passenger capacity as per vehicle type must be respected — no overloading
- Seatbelts must be worn by all passengers at all times
5.3 Prohibited Activities During Rides
- Consumption of alcohol, drugs, or any intoxicating substance
- Smoking, vaping, or use of tobacco products inside the vehicle
- Carrying illegal items, weapons, explosives, or hazardous materials
- Abusive, threatening, or inappropriate behavior towards the driver
- Damaging, defacing, or soiling the vehicle interior
- Travelling with pets without prior approval
6. Pricing & Payment
- All pricing is agreed upon in advance — either through the corporate contract or per-booking confirmation
- No surge pricing — prices are fixed as per agreed rates
- Corporate clients receive monthly invoices with detailed trip reports and GST-compliant billing
- Individual bookings can be paid via UPI, bank transfer, or cash (as agreed)
- GST is charged as applicable under the GST Act, 2017 for transportation services
- All invoices carry valid GSTIN of Baste Tour and Travel
7. Cancellation & Rescheduling
- Cancellations made 2+ hours before the scheduled ride: No charge
- Cancellations made less than 2 hours before: 25% of ride fare
- Cancellations after driver dispatch / no-show: 50% of ride fare
- Corporate contract cancellations are governed by the specific contract terms
- Rescheduling is free if communicated at least 1 hour before the ride
8. Liability & Insurance
- All vehicles carry comprehensive motor insurance and passenger liability insurance as mandated by the Motor Vehicles Act
- Baste Tour and Travel shall be liable for damages caused due to proven negligence of the company or its drivers
- We shall not be liable for delays or cancellations caused by force majeure events (natural disasters, strikes, government orders, extreme weather, road blocks, riots, etc.)
- Personal belongings left in the vehicle are the passenger's responsibility; we will make reasonable efforts to recover lost items but assume no liability
- Passengers are responsible for damage caused to the vehicle by their actions — repair/cleaning costs will be billed
9. Intellectual Property
- The name "Baste Tour and Travel", "Baste Go", logos, website content, and all associated branding are the exclusive intellectual property of Somnath Baste (Proprietor)
- Unauthorized use, reproduction, or imitation of our brand identity is prohibited and subject to legal action under the Trade Marks Act, 1999 and Copyright Act, 1957
- All rights, title, and interest in the Baste Go application (when launched) remain with the Company
10. Dispute Resolution
- All disputes shall first be attempted to be resolved through amicable negotiation
- If unresolved within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996
- The seat of arbitration shall be Pune, Maharashtra
- The language of arbitration shall be English/Hindi/Marathi
- The decision of the arbitrator shall be final and binding on both parties
11. Governing Law & Jurisdiction
These Terms and Conditions are governed by the laws of India. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.
12. Amendments
Baste Tour and Travel reserves the right to amend these Terms and Conditions at any time. Changes will be effective upon posting on our website. Continued use of our services constitutes acceptance of the amended terms.
13. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
